Terms of Service

1. Acceptance of Terms

By accessing or using Optimiseres ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including administrators and API consumers.

2. Description of Service

Optimiseres provides a secure platform that connects AI tools to Walmart's advertising APIs via the Model Context Protocol (MCP). The Service includes:

• OAuth 2.1 authorization server for secure authentication.
• MCP server providing structured access to Walmart advertising data.
• Admin dashboard for user management, permissions, and analytics.
• API endpoints for programmatic access to advertising tools.

3. Account Registration

To use the Service, you must create an account with accurate information. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized access.
• Keeping your account information up to date.

Accounts require admin approval before access is granted. We reserve the right to refuse or revoke access at our discretion.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these terms. You must not:

• Attempt to bypass authentication, authorization, or rate limiting.
• Access data belonging to sellers or accounts you are not authorized to manage.
• Use the Service to violate Walmart's advertising policies or terms of service.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Share access tokens or credentials with unauthorized parties.
• Use automated tools to scrape or overload the Service beyond normal usage.

5. Seller Permissions

Access to advertising data is governed by seller-level permissions. Administrators assign specific sellers and permission tiers (Read, Write, Manage) to each user. You must only access data within your assigned scope.

6. API and MCP Usage

API access is subject to rate limits and fair use policies. We reserve the right to throttle or suspend access if usage patterns indicate abuse, excessive load, or unauthorized activity. OAuth tokens expire and must be refreshed according to the standard flow.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein. Advertising data accessed through the Service remains the property of the respective Walmart seller accounts.

8. Intellectual Property

The Service, including its design, code, documentation, and branding, is the property of Optimiseres. You may not copy, modify, distribute, or create derivative works without prior written consent. Your use of the Service does not grant you any ownership rights.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible).
• Upstream API outages from Walmart or third-party providers.
• Security incidents requiring immediate response.

10. Limitation of Liability

To the maximum extent permitted by law, Optimiseres shall not be liable for:

• Indirect, incidental, or consequential damages arising from use of the Service.
• Loss of revenue, data, or business opportunities.
• Errors in advertising data provided by Walmart's APIs.
• Actions taken by AI tools based on data received through the Service.

The Service is provided "as is" without warranties of any kind, express or implied.

11. Termination

We may suspend or terminate your access at any time for violation of these terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, but provisions regarding liability, intellectual property, and dispute resolution survive.

12. Changes to Terms

We may update these terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
